On 7th July 2022 police officers of Kagdapith Police Station, Ahmedabad beat up and tortured seven Adivasi labourers in custody as they were travelling from Kutch to their hometown, Dang. An FIR was registered and transferred to the same police station where the atrocity took place. The FIR has been registered only under nominal sections 323, 294(b) and 114 of IPC whereas the gruesome way in which they were attacked attracts the SC/ST PoA Act as the Police very well knew the seven people they were torturing were Adivasis and this knowledge is enough to attract the SC/ST PoA Act.
Furthermore, the actions of the Police attract more stringent sections of the IPC - sections 325 and 331. This point has been clearly articulated in the complaint to the NHRC.
Through the victim's father, a complaint in the National Human Rights Commission (please find attached). On the basis of the complaint, the NHRC has ordered the Commissioner of Ahmedabad to take appropriate action on the complaint within 8 weeks and report the action taken to the victim.
